Gram Hoshizaki terms

Hoshizaki warrants that under normal use in accordance with the accompanying user manual, the Products will be free from defects at the time of delivery to the purchaser and for a specified period from the delivery date (or any other period that the parties may have agreed in writing) to concerns MATERIAL and manufacture and will substantially conform to Hoshizaki's specifications for the relevant Product or, if applicable, other specifications agreed by Hoshizaki in writing.

8.2 Hoshizaki's sole and exclusive obligation and purchaser's sole and exclusive right in connection with any claims arising from the applicable warranty are limited, at Hoshizaki's option, to either replacement or repair by Hoshizaki (or a distributor designated by it. / dealer or authorized and qualified service provider) for a defective or non-conforming Product, or in return for the purchase price of the Product. Hoshizaki will be given a reasonable period of time for repair, replacement or compensation. Non-conforming or defective Products become the property of Hoshizaki as soon as they are replaced or reimbursed for them.

8.3 Notwithstanding the foregoing, Hoshizaki has no obligations under the warranty if it is found that the claimed defect or non-conformance to specifications is due to power failure or incorrect connection of the Product to the electrical network, incorrect connection or failure of water supply or discharge respectively to and from the Product, testing under special conditions of use, incorrect use, use in a manner other than described in the user manual, insufficient care, improper installation or an accident, or to improper repair, adjustments or changes or storage or incorrect transport, or incorrect treatment, cleaning or maintenance of the Product, external cooling installations (remote) and defects caused by external cooling installation and / or other technical installations.

8.4 The express warranty set forth above applies directly to the purchaser and not its customers, agents or representatives and is in lieu of all other warranties, express or implied in nature, including, but not limited to, any implied warranties of fitness for a particular purpose, merchantability, or non-infringement of intellectual property rights. All other warranties are hereby specifically disclaimed by Hoshizaki.

8.5 With due observance of the exclusions and limitations set out in Article 9 of these General Delivery Conditions, the foregoing reflects Hoshizaki's entire liability in connection with defective or non-conforming Products.

Warranty periods
Gram: Superior - Eco - Gram Plus, Twin, Midi, Euro, Gastro and Baker line: 3 year full warranty on parts, travel costs and hours. 5 years on parts.
Gram Compact, Process, Standard Plus and CF: 2 year full warranty on parts, travel costs and hours.
Gram Marine and export: 2 year parts only warranty.
Hoshizaki and Snowflake: 2-year full warranty on parts, call-out costs and hours.
Warranty on applied Spareparts is 6 months.

Not covered by warranty.
Work or adjustments without prior approval or not on behalf of Hoshizaki, or the consequences thereof. Rate working hours and call-out fee to service partners in excess of amounts set by Hoshizaki. Core sensor, lamps and door seals (also hours and front row in relation to this) Wear sensitive parts such as door seals and calcification of parts. Parts supplied by third parties under warranty unless prior written agreement. Refrigerant price higher than 20% of the average purchase value applicable at that time. Work on or control with regard to remote installations. Refrigerant consumed beyond content on Hoshizaki equipment. More call-out costs than necessary per disruption. Hours of work in excess of reasonably necessary to perform task. Hours of mandatory safety instructions for the account of the customer. Costs of moving equipment to a location where work can / may be carried out. Working hours for gaining access to the execution of the technical activities, such as expanding the Hoshizaki product. Security costs at work location where this is requested by the customer. Faults as a result of overdue maintenance. Failure as a result of lack of demonstrable maintenance from year 1 after invoice date.
